International IP Seminar: Saurabh Vishnubhakat, "Constitutional Structure in the Patent Office"
1:15 - 3:15 p.m. in 120 and on Zoom
Saurabh Vishnubhakat, professor of law and director of the Intellectual Property and Information Law Program at the Cardozo School of Law, will speak in person.
Agencies in the modern administrative state are no strangers to constitutional attack. However, the Patent Office is a newcomer to such crises and has most recently dodged two. The agency’s decade-old administrative adjudication system was recently found in violation of the Appointments Clause, and the judicial remedy solved the problem but exposed latent structural problems that still persist. Meanwhile, the details of Patent Office adjudication present Due Process concerns about impartiality and moral hazard, and the two occasions for judicial redress both ignored the problem. These seemingly disparate issues arise from a shared underlying legislative failure to differentiate the agency’s political role in executive decision making from its technocratic role in expert adjudication. Without confronting this defect in Patent Office structure, efforts to resolve current constitutional difficulties and avoid future ones are unlikely to succeed. Resolving this defect, however, can begin to deconstitutionalize the perennially high stakes of Patent Office adjudication.
The program is sponsored by the Center for Intellectual Property and will be introduced by Prof. Marshall Leaffer. The lecture is open to all Law School students and faculty.
The Indiana Office of Admissions & Continuing Education approved this lecture for 1.5 hours of CLE.

Family Office Program looking for business-oriented 1Ls for summer internships
Indiana Law's Family Office Program (FOP) is seeking to increase the number of 1L FOP Fellows in anticipation of a significant number of paid family office summer 2026 internships. The FOP is especially well suited for students interested in business transactional work, real estate, tax, and/or sophisticated trust and estate planning.
A family office is a group of professionals (from one to several hundred) who manage the business and personal affairs of high-net-worth families (typically > $500M), often after the sale of a large operating business. The family office sector is a large and growing sector of the global economy. It is estimated to hold more than $6 trillion and has become a major driver of sophisticated transactions that are traditionally the province of large publicly traded companies or private-equity firms. Because many law firms highly value family office clients, FOP internships are often helpful for 2L summer employment.
The FOP was founded in 2020 by Mike Flannery '82, who served as CEO of Duchossois Capital Management, a prominent family office in Chicago. Now in its sixth year, the FOP has admitted a total of 25 Fellows, including nine alumni currently in practice. Interested 1L students should send their resume to the FOP Faculty Director, Professor Bill Henderson, at wihender@iu.edu.
