Conservation Law Center Prevails at the Indiana Supreme Court
The CLC, with staff attorney Jeff Hyman as lead counsel, has prevailed in a case that has repercussions for advocacy organizations throughout Indiana. The case came before the Indiana Supreme Court after the plaintiff, Indiana-Kentucky Electric Corporation (IKEC), appealed the ruling of the Court of Appeals that IKEC could not relitigate whether environmental groups can initiate administrative proceedings on behalf of aggrieved members, an issue that had been decided in 2005. In his oral argument before the Supreme Court on March 15, Jeff defended the finality of the 2005 decision and addressed the Justices' broader questions regarding associational standing. On March 22, the Supreme Court, upon consideration of the oral arguments, issued an order reversing its decision to grant transfer, thereby denying IKEC's petition and reinstating the opinion of the Court of Appeals favorable to CLC's clients.
Prof. Seth Lahn delivered a talk on March 3 at Harvard Law School on the topic, "Reports From the Field: What Studying Reflective Essays Empirically Can Tell Us About Student Externship Experience," as part of the Externships 6 Conference.
Prof. Amy Applegate and Prof. Seth Lahn participated in the Indiana Supreme Court's Access to Justice workshop on March 22 and 23 in Indianapolis, convened to study whether or not Indiana should join other states in creating a permanent Access to Justice Commission.
