Faculty News
The University of Colorado Law Review just published Professor Fischman's latest article, "The Story of Kleppe v. New Mexico: The Sagebrush Rebellion as Un-Cooperative Federalism." His co-author is a recent graduate some might remember, Jeremiah Williamson, JD'10, who is now an assistant attorney general in Wyoming. The article explains how assertion of federal power advancing national conservation objectives collided with traditional, local economic interests on public lands in the 1970s. It connects that history with current approaches to natural resources federalism. You can read an abstract or download the pdf of the article.
On February 2, 2012, Prof. Leandra Lederman presented her paper titled "Measured Tax Enforcement" (co-authored with Ted Sichelman) in the Tax Policy Colloquium at the University of Florida Frederic G. Levin College of Law. She spent two weeks at Florida Law School as the Visiting Tax Research Scholar.

Discussion Panel: Is Affirmative Action Headed Back to the Supreme Court?
In celebration of Black History Month, the Black Law Students' Association and the Latino Law Students' Association invite you to attend our discussion panel on the University of Texas at Austin's use of affirmative action in its admissions policy. UT reintroduced race into its admissions process in 2003 following the Grutter v. Bollinger decision. In 2008, a federal district court ruled in favor of the school's affirmative action policy. The Fifth Circuit unanimously affirmed the decision.
The panel will consist of Prof. Bell, Prof. Conkle, Prof. Fuentes-Rohwer, and Prof. Johnsen. Prof. Brown will serve as the moderator. Some of the issues that will be discussed are critical mass and under-representation; whether the Supreme Court is likely to grant certiorari; how the case will likely be decided; and the effect the case may have on minority groups such African-Americans and Hispanics. Monday, February 27, Moot Court Room, noon.
