Indiana Law Noted & Quoted

The U.S. Supreme Court has granted cert in Kimble v. Marvel Enterprises, Inc., asking the court to overrule Brulotte v. Thys Co., which held that a patentee's use of a royalty agreement that projects beyond the expiration date of the patent is unlawful per se. Professor Mark D. Janis filed an amicus curiae brief in support of the petitioner. Interestingly, the Solicitor General filed a brief recommending denial of certiorari. Janis's brief was the only amicus brief filed by academics.
