All of the report is admissible.
1) The report and the observations of the EMT fall into the public records exception for matters observed and recorded pursuant to official duty. The Fire Department is a public agency.
2) The statements of the plaintiff are hearsay within hearsay, but are excited utterances, statements of then-existing physical condition, present sense impressions and statements for medical purposes as we discussed in the previous class.
3) The statement of the bystander is also hearsay within hearsay, but are excited utterances.
